ADR in Luxembourg
ADR is a widely accepted alternative of resolving without civil action in public Court. Public courts may be asked to review the validity of ADR methods, but they will rarely overturn ADR decisions and award if the disputing parties formed a valid contract. Arbitration and mediation are the two major forms of ADR.
Mediation is a method with a neutral person helping the parties find a solution to their dispute. Since mediation is less rigid than both litigation and arbitration, it allows for creative techniques that would not be acceptable in other settings. For example, a mediator can speak ex parte with each side to find mutually acceptable solutions that might not otherwise emerge.
